Waiver / liability release

Waiver and Release of Claims and Liability

All students and participants must sign this waiver of claims and liability.

Assumption of Risk: Using the Highland Park Fight Club LLC (“HLPFC”) facilities may involve the risk of injury to you whether you or someone else causes it through action, inaction, negligence or otherwise. Attendance in HLPFC classes of Brazilian Jiu Jitsu, Nogi Grappling, Submission Wrestling, Self Defense, Boxing, Striking, Kickboxing, Muay Thai, Fundamental, Advanced, or seminars (collectively referred to as the “Classes”), have specific risks that vary from one activity to another and the risks range from minor injuries to major injuries, such as catastrophic injuries including death. Regarding your participation in the any activities offered by HLPFC, you understand and voluntarily accept this risk and agree that HLPFC, its shareholders, officers, directors, employees, volunteers, agents, independent contractors, affiliates, William Allen, Andrew Im, Kelby Wood, and Jason Eisner (all collectively referred to as “Mangers”) will not be liable for any injury, including, without limitation, personal, bodily, or mental injury, economic loss or any damage to you, your spouse, guests, unborn child, or relatives resulting from the negligence of HLPFC or anyone on HLPFC's behalf or anyone using the facilities whether related to exercise, Classes or otherwise. Further, you understand and acknowledge that  HLPFC does not manufacture fitness equipment at its facilities, but purchases such equipment, and you understand and acknowledge that  HLPFC is providing recreational services and may not be held liable for defective products. Furthermore, you acknowledge that there may be risks not known to you and/or not reasonably foreseeable at this time, but you personally, totally and completely assume all risks involved or in any way related to your participation at any activities at HLPFC facilities and in Classes. 

Health Warranty: You represent that you are in good health and have no disability, impairment, injury, disease, or ailment, preventing you from engaging in Classes, active or passive exercise, or which could cause increased risk of injury or adverse health consequences as a result of exercise. You agree to assume full responsibility for your use of an HLPFC facility and/or Classes and shall indemnify HLPFC and Managers against any and all Damages arising out of your use of the facilities.

Medical Disclaimer: You acknowledge that HLPFC has made no claims as to medical results that can or may be obtained through use of any HLPFC facility or Classes. HLPFC has neither suggested nor will it suggest any medical treatment to Members and Guests at its facilities. Only licensed medical professionals are qualified to give medical advice. You represent that there is no medical or physical condition that would preclude you from the use of  HLPFC 's facilities and you further represent that you have not been instructed by any physician not to use HLPFC's facility or any similar facility. You also certify that you are covered by a medical insurance plan and will assume responsibility for all bills/costs associated with all injuries sustained while attending any HLPFC Classes. 

Indemnity: You agree to indemnify HLPFC, its shareholders, William Allen, Andrew Im, Kelby Wood, Jason Eisner, and Managers against any and all liability incurred by you during your use of any and all HLPFC facilities. 

Governing Law: This Agreement shall be interpreted under the laws of the State of California.

By signing below, you acknowledge and agree that you have read the foregoing, you agree to all terms herein, you will abide by all rules of HLPFC, and that Classes are voluntary and participation is entirely of your own free will.

Gym Etiquette & Rules 

1. No shoes or footwear on the mats and always wear flip flops or shoes off the mats. 

Keep our mats clean and keep your feet clean especially when you go to the toilet and always wash your hands.

2. Maintain personal hygiene 

Out of respect for your training partners and teammates, come to class clean, smelling good, and not directly from a very dirty environment such as a hospital or live demo site.

3. Cut your nails and remove all jewelry

Jiu Jitsu is a contact sport so please keep your training partners safe and free of cuts or scrapes.

4. No open cuts on the mat 

If you have any minor cuts, tape them up fully. If you have any serious cuts or injuries, then you should not train.

5. Clean your uniform and all gear after every use

Please wash all of your gear (including your belts) after every use. Reusing gear without washing is unhealthy and may lead to skin infections for you and your teammates.

6. Don’t train while sick

If you are sick don’t train and expose your training partners to your illness – rest up and come back strong.

 
7. Be on time 

It’s tough in LA to predict traffic, but please do your best to be on time and if you do arrive late please be respectful to your teammates by quickly joining in the group’s activity.

8. No Unwelcome Advances

HLPFC has a zero tolerance policy for unwelcome advances of a sexual nature towards other students. Grappling is a sport which involves physical contact between training partners and so it is extremely important that every student feel comfortable and free from unwanted advances or attention of a sexual or romantic nature whether made in earnest or in jest. The mats are for training, not dating. 

9. No hard plastic on the grappling mats

Hard plastic wrestling ear guards and joint protectors can hurt your training partners and/or damage our grappling mats. If you prefer to use gear like this, please look into foam and soft options without hard plastic.  

10. Respect privacy

Privacy is important especially while sparring. Your teammates do not want to show up in a video on the internet without their permission. Please ask any training partner before recording or photographing any activity on the mats.

11. No side coaching (especially parents)

HLPFC has well trained coaches who know the details and objectives of classes and sessions. Parents, please do not coach your children from off the mats unless you are experienced and know you are giving sound advice. Students: Please do not coach your training partners unless you are a higher belt and are certain you have a good understanding of the technique in question. While well intentioned you may unknowingly be misinforming your training partners. If you are unclear on when you should help or offer advice to another student please ask a coach.
